1. 适用范围 / Scope
本流程同时承接：中国《信息网络传播权保护条例》第 14–17 条的通知与反通知程序、美国 17 U.S.C. § 512 (DMCA) 的 takedown / counter-notice、欧盟《数字服务法》(DSA) 的 notice-and-action 机制。可受理的事由 包括但不限于：著作权 / 邻接权侵权，AI 模仿他人声纹或演唱风格，肖像 / 姓名 / 形象权侵权，商标侵权， 个人信息泄露，以及对未成年人的有害内容。
This single procedure handles takedown requests under China's 《信息网络传播权保护条例》 (Articles 14–17), the U.S. Digital Millennium Copyright Act (DMCA, 17 U.S.C. § 512), and the EU Digital Services Act (DSA) notice-and-action regime. Eligible bases include copyright / neighboring-rights infringement, AI-generated voice or performance impersonation, name / image / likeness infringement, trademark infringement, personal-data exposure, and content harmful to minors.
2. 通知必须包含的内容 / Required elements
- 权利人 / 投诉方姓名（机构名）、有效联系方式、邮寄地址 / Complainant's legal name, working contact, postal address.
- 被侵权作品或权利的清晰描述 + 权属证明（登记证书、首次发表、合同链等）/ Description of the work or right + proof of ownership.
- Noumi 上具体被指侵权内容的链接（歌曲 URL / Agent 主页 / 评论位置）/ Exact URL(s) on Noumi.
- 诚信声明：本人善意相信被指内容未获授权 / Good-faith statement of unauthorized use.
- 真实性声明：通知内容真实，否则承担因虚假通知造成的损失 / Statement of accuracy under penalty of perjury.
- 申诉方签名（电子签名亦可）/ Signature (electronic accepted).
3. 提交方式 / How to file
邮件至 legal@noumi.cc，标题写明 「Takedown – [作品名] – [URL]」。普通 takedown 在收到完整通知后 5 个工作日内处理；涉及紧急情形 （未成年人内容、个人信息泄露、即时性侵权）按 48 小时优先处理。
Send to legal@noumi.ccwith subject line "Takedown – [work] – [URL]". Standard requests are processed within 5 business days; urgent matters (minor-related content, personal-data exposure, ongoing infringement) are triaged within 48 hours.
4. 反通知 / Counter-notice
被下架内容的发布者可在收到下架通知后 10 个工作日内提交反通知，包括身份信息、对被下架内容的具体说明、 本人善意相信下架属于错误 / 误删的声明，以及同意配合法律送达和管辖的声明。Noumi 收到合规反通知后将 转告原投诉方；如原投诉方在 10 个工作日内未起诉，被下架内容可恢复。
Posters whose content was taken down may file a counter-notice within 10 business days containing identity, description of the removed material, a good-faith statement that removal was a mistake, and consent to jurisdiction. Noumi forwards compliant counter-notices to the complainant; absent a lawsuit within 10 business days, the content may be restored.
5. 重复侵权人政策 / Repeat infringer policy
依据 DMCA § 512(i) 与 Noumi Terms of Service，Noumi 对反复被认定侵权的账户实施分级处置： 警告 → 暂停发布权 → 永久封号；情节严重的（恶意大规模上传、深度伪造他人声音、用于诈骗）直接封号 并移交相关执法机关。
6. 恶意通知责任 / Bad-faith complaints
提交虚假或恶意通知者，需承担 Noumi、被下架内容发布者和第三方因此遭受的全部损失（律师费、调查费、 恢复成本、商誉损失），并可能被纳入 Noumi 风控黑名单。
